Fair Use Policy
This Fair Use Policy applies to you if stated in our offer to sell you electricity. It should be read with the Pricing Statement for our offer and our Market Retail Contract Customer Terms and Conditions. Capitalised terms that are not defined in this Fair Use Policy are defined in our Market Retail Contract Customer Terms and Conditions.
What is the purpose of this Fair Use Policy?
This Fair Use Policy is intended to ensure that:
electricity provided by us to you is used by you principally for personal, household or domestic use; and
subject to all applicable laws, you do not use that electricity in an excessive or unreasonable manner, including in any manner specifically excluded by your energy offer.
How will we determine if your electricity usage is excessive or unreasonable?
In this section “Electricity Usage History” means:
if we have been your electricity retailer for the Premises for 12 months or more, your use of electricity at the Premises:
over the most recent 12 month period; or
over the same quarter or quarters in the previous 12 months,
based on Meter readings; or
if we have been your electricity retailer for the Premises for less than 12 months, our estimate of your electricity usage during the previous 12 month period, or any quarter or quarters. In estimating your electricity usage, we will have regard to any relevant information that is available to us, which may include comparing your usage with the model annual usage set by the Australian Energy Regulator for the distribution network for the Premises for that period.
We will assess your Electricity Usage History to determine if your electricity usage is excessive or unreasonable, having regard to the addition of electric vehicle charging and whether any aspects of your electricity use are specifically excluded by our energy offer.
We may consider your electricity use excessive or unreasonable where your usage significantly exceeds your Electricity Usage History, or where you are not using electricity principally for personal, household or domestic purposes (for example, by operating industrial, agricultural, or commercial machinery or equipment, providing commercial residential services, or mining cryptocurrency).
What happens if we consider your electricity usage to be excessive or unreasonable?
If we consider your electricity usage to be excessive or unreasonable, we may, acting reasonably and with appropriate written notice to you:
end the Agreement and seek to negotiate a new market retail contract with you; or
end the Agreement and continue to sell you electricity under a Standing Offer.
We will give you at least 20 Business Days prior written notice of this, which will include the options available to you if the Agreement is varied or ends.
Amendments to this Fair Use Policy
We may amend this Fair Use Policy from time to time. We will give you at least 20 Business Days written notice of any amendments. If you do not agree with the amendments, you may end the Agreement. If you end the Agreement, we will continue to sell you electricity under a Standing Offer until you enter into a new market retail contract with us or another retailer.
